Booking Terms and Conditions
All participants must be aware of Camp Pikorua Training Retreat terms and conditions. We take your personal safety very seriously and as a company, we trade in a clear and fair manner.
We do strongly advise that you take out travel insurance when you book your stay at Camp Pikorua Fitness Retreat Spain.
Camp Pikorua Fitness Retreat, known from here on as CP, accepts bookings subject to the following conditions:
In this document wherever the context so admits, the following expressions shall have the following meanings respectively:-
“Head office” means: Camp Pikorua Fitness Retreat, Villa Pikorua, Paraje Cortijo Curato (EL) S/N. Bedar, 04288, Almeria, Andalucia, SPAIN.
“CP” means: Camp Pikorua Fitness Retreat.
“Client” means: the person or persons listed on the booking form(s).
“Major change” means: changing the dates or location.
“Force Majeure” means: any situation or event beyond the control of CP. This could be an Act of God, war, terrorist activity, civil strife, strike, riot, industrial disaster, fire, adverse weather or road conditions, bureaucratic obstacles, changes in schedules or modes of transport by ferry companies, airlines and bus or train operators.
“Course Director” means: the member of staff responsible for the delivery of the agreed activity and/or service.
Where the expression “Clients” includes two or more persons, the obligations expressed or implied relate directly to the individual. Wording importing the singular meaning shall include the plural meaning and vice versa. All wording within the booking conditions is generalised to the Client referring to the masculine feminine and neuter genders.
The clause and paragraph headings are for convenience and clarity only and shall not affect the construction of this document. The expressions used in the particulars shall have the same meanings when used hereafter in these booking conditions.
A contract for your course is made between CP and the Client on the issue of written confirmation of booking by CP. The Contract is subject to these booking conditions which the Client has been deemed to have read and fully understood. These booking conditions can only be varied by written agreement between CP and the Client. Verbal representations made by CP shall be confirmed in writing to the Client.
To place a booking, CP requires a completed Booking Form and/or Individual Information Form along with the non-refundable 50% course booking fee. Clients booking will have been deemed to have read the booking conditions and to have signed the declaration on the “individual information form”.
A booking is accepted and becomes binding only from the date when CP has confirmed acceptance in writing, via a “confirmation of booking email or letter”. Email and telephone bookings are treated as provisional and are only confirmed once the full course fees have cleared into the CP bank account. CP reserves the right to decline any booking at their discretion. The whole course fee is required to secure a place for any booking.
The price at the time of booking is all inclusive. It covers the cost of the planning, organising and delivery of the course content, full accommodation and all meals.
Once the full fee is cleared the agreed programme will be delivered. If the Client wishes to change the programme once the full fee has been paid, additional reasonable costs may be levied by CP at their discretion.
It is the responsibility of the Client to arrange their travel to Spain for the course.
The Client is also responsible for their personal medical requirements and personal footwear, equipment and clothing unless otherwise stated. CP will provide Clients with a recommended kit list for their stay.
The CP residential courses are held over a minimum of 6 days. Clients may choose to extend their stay for longer periods.
To book a place on a CP course, Clients are expected to arrive on chosen day one of the course. Clients who cannot arrive on day one of their course must inform CP as soon as possible. In exceptional and unforeseen circumstances, Clients who need to leave during the course, but who wish to return at a later date, may do so by special arrangement with CP.
Clients shall be held responsible to make compensation for any damage they may cause to the contents and furnishings of their accommodation during their stay.
Should the Client wish to cancel, cancellation charges will be imposed. These are calculated from the date written notification is received by CP at their Head Office and shall be calculated as a percentage of the total price.
Number of days before arrival date that the written notification of cancellation is received:
4 weeks or less: No refund given.
6 weeks: 75% of the full cost will be due to CP
8 weeks: 50% of the full cost will be due to CP
Cancellation by CP
We try never to cancel a confirmed booking but reserve the right to do so. If we cancel a confirmed booking before your course CP will offer the Client the choice of a full refund or another available date.
Alteration by CP. We make every effort to ensure the accuracy of our literature. However changes can occur despite our best endeavours and we reserve the right to change any price or other particulars before the Client books, in which case we will tell Clients before their booking becomes binding.
If there is a “Major Change” to a confirmed booking we will inform the Client as soon as is reasonably practicable and offer the choice of accepting the change or transferring to another available date. If the Client chooses to cancel and the “Major Change” was caused by anything other than “Force Majeure” or other unforeseen circumstances, the 50% booking deposit will be retained by CP. If there are any minor changes that need to be made, we are not obliged to inform the Client in advance, however, we will always try to do so wherever practicable; nor are we obliged to pay the Client compensation. If we become unable to provide a major proportion of the services the Client has booked with CP we will make every effort to arrange alternative arrangements for the Client at no extra charge and, where appropriate, we will refund the Client pro-rata for services not received.
The information we publish in our literature and on our website, describing the courses, is designed to be illustrative in order to best explain the scope and type of activities Clients will be undertaking. Several factors will dictate what can be accomplished reasonably during a course. The most influential factors will be the weather, the conditions and physical fitness of course participants.
Taking these factors into consideration, the Course Director will construct the best programme possible. The Course Director will review and may alter the programme as the course progresses in response to the changing influence of these factors. Once the course is underway the Course Director, instructors or leaders may change the activities at any time. This applies to all courses.
Health and Safety and Acceptance of authority.
Our Course Director, instructors and leaders will do their utmost to ensure that any problems are solved for the benefit of the course participants as a whole. Signing the booking form signifies the Client’s acceptance of the Course Director’s authority to make decisions affecting the health and safety of the group or individuals. The Course Director may require an individual or individuals to leave the course if, for example:
they believe that a person or person’s health is at risk
if a Client has committed an illegal act during their stay at CP.
If a Client’s conduct has been , is or may become detrimental to the safety, enjoyment or well-being of the group or of any individual within the group.
In the event of an illegal act having been committed, or the Client having behaved in a way as to endanger safety enjoyment or the welfare of the group as a whole, the Client involved shall not be entitled to any refund from CP and shall be required to meet all expenses involved in their immediate extraction.
Except as disclosed in writing to CP, Clients confirm that they are in good mental and physical health and are unaware of any reason why they may be particularly unsuited to taking part in the course activities or may be likely to suffer illness or injury during the course activities. Failure to disclose any information that is required in the ‘Individual Form’ may result in CP terminating the contract and withdrawing the Client from the course on the grounds of incorrect information. The Client will not be entitled to any refund of payments made under this termination clause.
General points. The Contract is personal to the Client and is not capable of transfer or assignment without prior written consent of CP. While it is the intention of CP to perform the obligations under this contract directly CP may choose to sub-contract elements of its obligations under this contract.
If there is a problem during the course period the Client must report it to in the first instance the instructor of their activity. If it is still unresolved the Client must then report it to the Course Director of CP immediately so that prompt and effective efforts can be made to resolve the problem. In the unlikely event that the problem cannot be resolved at this time and the Client wishes to raise a complaint, full written details must be sent to CP within 28 days of the course finishing. The Client must include their booking reference number, party details and exact full details of the complaint on their letter. The Client must also include their daytime and evening contact telephone numbers. Failure to take these steps will prejudice our ability to resolve any problem and/or investigate it fully.
As part of the continual review of safety and associated considerations, the conditions of booking are subject to change, clarification and modification at any time. Only the Course Director or their appointed Deputy is empowered to vary or waive any of the Conditions of Booking. Such decisions are totally at the discretion of the Course Director or the appointed Deputy.
The results achieved at CP are based on the mean average data of our previous Clients. However, individual results can vary.
